Welcome to Kitty Cleaner Website and App terms and conditions for use (“Terms”). These Terms of Use set out the terms and conditions under which individuals may use the website or mobile application and access the services offered by Kitty Cleaner Limited. ("Kitty Cleaner").

 

These Terms of Use comprise a legal agreement between Kitty Cleaner and you, the person accessing and using the website or mobile application ("You" or "User"). Kitty Cleaner owns, operates and maintains the Kittycleaner.com Website and App collectively referred to as the "Platform". By downloading, accessing and/or using the Platform, you are deemed to have read the Terms of Use and you agree to be bound by the Terms of Use which shall govern your access and use of the Platform and all applicable laws and regulations.

1.DEFINITIONS

“Booking” means a booking for Services made by You on our Website

“Services” means cleaning services or other home services;

“worker” means a cleaner, housekeeper, handyman or other home services provider available through our Website;

“We/us” means KITTYCLEANER LIMITED of 85 Great Portland Street, London, W1W 7LT, with Company Registration Number 14458017;

“Website” means the website located at https://kittycleaner.com or App called Kitty Cleaner or any subsequent URL which may replace it;

“You” means a user of this Website

2.Description of Services

 

2.1 Kitty Cleaner(We) act as a booking agency for self-employed worker to offers a range of housing services providers, including, but not limited to, domestic cleaning, housekeeping, handymen work, and pet sitting (collectively referred to as "Services").

2.2 Kitty Cleaner’s service provided Service by search types of function need based on users preferences and needs.

2.3 Kitty Cleaner is responsible for providing the Services to you and you have a direct contract between you and the Worker concerning the provision of Services. This contract does not include us. You and Worker are responsible for any taxes arising as a result of the Services.

2.4 We review applications, conduct interviews and undertake other checks of Workers, with some of this process reliant on information from or undertaken by third parties. You acknowledge that we do not and cannot guarantee the accurateness or completeness of such checks, whether conducted by us or by third parties.

2.5 You acknowledge that you use Workers at your own risk. You agree to provide a safe working environment for Workers and to take appropriate precautions to supervise Workers. We shall not, in any way, be liable to a Service Seeker or Service Provider or any other third party, arising, either directly or indirectly from such employment or independent contractor agreement between the parties.

2.6 Please refer to the Website/App or any platforms regularly for further information about the Services provided.

 

 

3.Application Use

 

3.1 Kitty Cleaner grants you the right to use the App for your personal use. You are provided with access to this App in accordance with these Terms and any Booking made by you must be placed strictly in accordance with these Terms.

3.2 You must comply with all applicable laws and third party terms of agreement when using the App (e.g. your wireless data service agreement). Your use of the App is at your own discretion and risk, and you are solely responsible for any damages to your hardware device(s) or loss of data that results from the download or use of the App.

3.3 You acknowledge and agree that the App may not contain the same functionality available on the Website. We cannot guarantee the continuous, uninterrupted or error-free operation of the App or that the App will perform at a certain speed, as this depends on a number of factors beyond our control. You agree that downloading, accessing and use of the App is made available to you on an "as is" and "as available" basis for use at your sole risk.

 

4.Eligibility Criteria

 

4.1 To be eligible to use the Services offered by Kitty Cleaner, you represent and warrant as follows:

4.2 that you are eighteen (18) years of age or older on the date of creation of your User Account;

4.3 if you are registering as Service Provider, that you are legally permitted to work in the jurisdiction where you are seeking employment; and

4.4 neither you nor any member of your household may have ever been the subject of a complaint, restraining order or any other legal action or criminal offence involving violence, abuse, neglect, fraud, or any other offence that involves endangering the safety of others, and that you are not registered or currently required to register as a sex offender with any government agency in any jurisdiction.

5.Booking Services

 

5.1 By placing an order through our App, you warrant that you are: legally capable of entering into binding contracts, and at least 18 years old.

5.2 All Bookings are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email on behalf of the selected Kitty Cleaner to confirm the Booking (the “Visit Confirmation”).

5.3 We do not take any responsibility regarding any booking outside of our platforms.

 

6.BOOKING CANCELLATION BY US

 

6.1 If you violate any of the Terms, your permission to use the Services and Website will automatically terminate.

6.2 We reserve the right to cancel any Booking without notice or cause.

 

7.BOOKING CANCELLATION BY YOU

 

7.1 You may cancel or reschedule a Booking until 18:00 the day before the Booking for free.

7.2 For cancellations after 18:00 the day before the Booking, or if your worker arrives for the clean and is unable to gain entry or start the clean, you will be charged the deposit paid price of the Booking. 

 

8.PRICE AND PAYMENT

 

8.1 The price of any Services will be as quoted on our App, except in cases of obvious error.

8.2 Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Visit Confirmation email.

8.3 Every effort has been made on this Website/App to ensure that making a Booking is secure. We cannot be responsible for fraudulent use on our Website/App of a lost payment card.

8.4 You must maintain a valid payment card with us. You must inform us immediately if your payment card details are no longer valid.

8.5 You authorise us to seek pre-authorisation of your payment card. You also authorise us to charge your payment card in full on the day of the scheduled Booking or after the scheduled Booking.

8.6 If any amount due by you is unpaid after the day of the scheduled Booking, we may charge a £10 administration fee and interest each month.

8.7 A promotional code, credit, gift card or voucher may only be used by new customers. Offer can only be redeemed once per household. Offer can only be redeemed once per customer. Offer can only be redeemed against home cleaning services (no add-on services), unless otherwise stated. Offer can only be redeemed against regular weekly or fortnightly cleans. Offers relating to a "First Clean" can be redeemed for a maximum of 3 hours. Other terms and conditions apply, including expiry. Please contact us for further details.

8.8 Kitty Cleaner operates a referral scheme that is open to selected users and is accessible from your account. You can share your referral code or link with people you know, who do not live at the same address as you and who you think would benefit from the Kitty Cleaner service. If a new user uses your referral code, you and your referred user may be eligible for referral benefits. Referral codes and links must only be used for personal, non-commercial purposes. For example, you may share your referral code or link on your personal social media accounts, but you agree that you will not share them on websites where you are not the account owner, including (but not limited to) Facebook business accounts or groups, Wikipedia, Google Reviews, coupon websites, and nor will you promote your referral code or link via advertising platforms including (but not limited to) Google Ads and Bing. We reserve the right to withdraw and deactivate your referral code, link and referral benefits at any time and will not be responsible for any losses you suffer if we withdraw and deactivate your referral code, link or referral benefits.

8.9 Kitty Cleaner may at its sole discretion offer its own discounts and promotional offers (“Kitty Cleaner promotional offers”) to potential and existing customers to promote Kitty Cleaner’s business as an agent.  These offers will not reduce the consideration received by the cleaner and may therefore entail Kitty Cleaner subsidising the consideration due to the cleaner in some circumstances.  The customer acknowledges that any consideration paid by the customer as part of a Kitty Cleaner promotional offer up to the amount of consideration that would otherwise be due to the cleaner at the agreed standard rates is wholly consideration due to the cleaner.

 

9.Use of the App/platforms, User Accounts and Passwords

 

9.1 To access and use certain features of the App, you will need to create a profile through the App ("User Account"). As part of the process to create, register and maintain your User Account you must provide Kitty Cleaner with certain current, complete, and accurate registration information, including your name, e-mail address, age, address, postal code/ZIP code, and phone number, and other data or information that has been requested by Kitty Cleaner during the client account registration or renewal process ("Registration Data"). If you are enrolling in Kitty Cleaner's Payroll Services  or work as a worker in the platforms, additional information, including your bank account number will be collected.

9.2 In these Terms of Use, "Personal Information" means any information about an identifiable individual, such as your name, e-mail address, mailing addresses, gender, date of birth, any data about you that you elect to provide electronically through the Platform and any other information that identifies who you are. Registration Data and Personal Information will be used by Kitty Cleaner solely in accordance with these Terms of Use and Company's Privacy Policy (the "Privacy Policy"). In addition, if you are accessing Kitty Cleaner's Services through the App, you may be asked permission to access to your location through your mobile device. Access to and use of your location information is consistent with the terms of our Privacy Policy.

9.3 You agree that you will:

 

• maintain and update such Registration Data as necessary in order to keep such information current, complete, and accurate;

• maintain the confidentiality of any passwords or other account identifiers which you choose or that are assigned to you as a result of any registration or account creation with the Platform; and

• be responsible for all activities that occur under such password or account.

• Further, you agree to immediately notify Kitty Cleaner of any unauthorized use of your password or account in the event that the confidentiality of your password or your account is compromised.

• Failure to comply with this paragraph may result in immediate termination of your account.

 

9.4 We reserve the right to:

 

• modify or withdraw, temporarily or permanently, this App (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the App; and/or

• change these Terms from time to time as explained below. If you do not agree to such amended terms, you must stop using the App. If you continue to use the App you will be deemed to have accepted the amended terms.

 

 

10.Personal Information

 

10.1 You agree that your use of the App and the Services is subject to the terms of our Privacy Policy, which is hereby incorporated by reference into, and forms an integral part of, the Terms of Use or by using the Platform, you expressly consent to the collection, storage, use and disclosure of your information, including your Personal Information, according to the Privacy Policy.

10.2 You represent and warrant to Kitty Cleaner that you are at least 18 years of age or have the permission of a parent or legal guardian (if between the ages of 13 – 18), and that you have the full, unrestricted right and authority and have been fully authorized to provide to Kitty Cleaner any and all Registration Data (including any Personal Information) for the purposes of these Terms of Use and that Kitty Cleaner is authorized and permitted to use such data as and to the extent provided in these Terms of Use and the Privacy Policy.

 

 

11.Content and Use of Services

 

11.1 As a Service Seeker, Service Provider or any other User of the Services, you agree that the content of information and materials posted on the Website or App by You is accurate, current and complete. In addition, you represent and warrant as follows:

11.2 You will use the Services provided by Kitty Cleaner soley for yourself and are responsible for all activity and use of your account and may not assign or transfer your account to any other person.

11.3 You will not provide inaccurate, misleading, defamatory or false information to Kitty Cleaner or to any other User of the Website or App.

11.4 You will not post any content (including, but not limited to, written material, text, photos, or graphical content) on the Website, App or any communication within Kitty Cleaner or transmit to other users, that is defamatory, inaccurate, inappropriate, abusive, obscene, profane, offensive, sexually oriented, threatening, harassing, defamatory, racially offensive, or illegal material, or any material that infringes or violates another party's rights (including, but not limited to, intellectual property rights, and rights of privacy and publicity), or advocate, promote or assist any unlawful act.

11.5 Your use of the Website, App and Services provided by Kitty Cleaner are in accordance with any and all applicable laws and regulations.

 

 

12.Use License

 

12.1 Kitty Cleaner hereby grants you a limited, non-exclusive, personal, non-transferable, non-sub-licensable and revocable right and license to access the Platform for the purpose of receiving the Services in accordance with these Terms of Use and access, view and print any information and documentation made available on the Website or App, for your personal, non-commercial and informational use only to assist you in the access and use of the Website or App and the Services.

12.2 These Terms of Use do not grant you any other right or license, whether express or implied, by estoppel, or otherwise in or under any patent, trademark, copyright, or other intellectual property or proprietary right of Kitty Cleaner or any third party.

12.3 Kitty Cleaner may terminate this license at any time for any reason whatsoever.

 

13.Intellectual Property

 

13.1 The Platform and all intellectual property rights in the Platform are owned by Kitty Cleaner.

13.2 Kitty Cleaner reserves all intellectual property rights, including but not limited to, copyright, trade-marks, domain names, design rights, brand elements, database rights, patents, and all other intellectual property rights of any kind, whether registered or unregistered.

 

 

14.Trade-marks

 

14.1 All brand elements, company name, website names, logos, registered and unregistered trade-marks displayed on the Platform or used in connection with the Services are the trade-marks of Kitty Cleaner (or its suppliers, partner businesses or third party licensors).

14.2 Any use or misuse of any trade-marks or brand elements of Kitty Cleaner or any other content appearing on the Platform or in connection with the Services except as provided in these Terms of Use or with the express written consent of Kitty Cleaner is strictly prohibited.

14.3 Nothing contained on the Platform shall be construed as an express or implied grant of any license or right to use any trade-mark or brand element without prior written consent of Kitty Cleaner.

 

 

15.Use Restrictions

 

15.1 In addition to complying with these Terms of Use, you agree to use the Platform and Services for lawful purposes only and in a manner consistent with all applicable local, national or international laws and regulations, including all privacy and personal information laws.

15.2 The App and any Services shall not be used where, and to any extent, such use is prohibited by law.

15.3 Kitty Cleaner encourages all Users to report any misconduct, misuse or unlawful activities of other Users, including, but not limited to activities on the Platform and in connection with the Services provided.

16.Termination of Registration

 

16.1 Kitty Cleaner reserves the right, in its sole discretion, to terminate your account or access to part or all of Kitty Cleaner’s Website , App and/or Services in the event that Kitty Cleaner determines you are not eligible to use the Services or have violated any of the provisions of the Terms of Use, or have misused the Website, App or Services in any way.

 

 

17.Limitation of Liability

 

YOU ACKNOWLEDGE THAT ANY USE OF OR RELIANCE ON THIS WEBSITE OR THE SERVICES IS COMPLETELY AT YOUR OWN RISK.

 

18.Language

 

It is the express will of Kitty Cleaner that these Terms of Use and all related documents on the Platform are in English.

 

 

19.Non-assignment

 

These Terms of Use are not assignable, transferable, or to be sub-licensed by you except with Kitty Cleaner's prior written consent. Kitty Cleaner may assign, transfer, or delegate any of its rights and obligations hereunder without your consent.

 

 

20.Modifications of Terms of Use

 

20.1 Kitty Cleaner may revise these Terms of Use at any time without notice. By using the Platform, you are agreeing to be bound by the current version of the Terms of Use and Privacy Policy (last updated date listed at the top of the Terms of Use).

20.2 The content and material appearing on the Platform could include technical, typographical or photographic errors. Kitty Cleaner does not warrant that any of the materials provided are accurate or current.
